Racial and Religious Hatred Act 2006

The Racial and Religious Hatred Act 2006 amended the Public Order Act 1986 to create offences of stirring up hatred against persons on religious grounds.
Key Requirements
Words or behaviour must be threatening — abusive or insulting language alone is insufficient. The prosecution must prove intent to stir up religious hatred.
Free Speech Protection — Section 29J
Critically, s.29J provides that discussion, criticism, or expressions of antipathy, dislike, ridicule, insult, or abuse of particular religions or beliefs is not in itself an offence. This protects robust debate about religion.
Penalties
Either-way offence — up to 7 years imprisonment. DPP consent required for prosecution.
