The Equality Act 2010 provides a civil framework for protecting individuals from discrimination and harassment related to protected characteristics.
Section 26 — Harassment
Harassment occurs where a person engages in unwanted conduct related to a relevant protected characteristic that has the purpose or effect of violating dignity or creating an intimidating, hostile, degrading, humiliating, or offensive environment.
Protected Characteristics
Age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, and sexual orientation.
Civil Only — Not Criminal
The Equality Act is enforced through Employment Tribunals and County Courts. It does not create criminal offences. Remedies include compensation (including injury to feelings), declarations, and injunctions.
Time Limits
Employment tribunal claims: generally 3 months less one day from the act. County Court: 6 years.
